It's a legal issue. Two things - in the United States, adult material that is legal requires 2257 compliance; any person on cam must submit certified copies of original documents stating they are over 18 etc. Obviously, unauthorized men don't do this.

Secondly, it crosses the boundary between softcore and hardcore adult content, and again for legal reasons MFC is not licensed to be considered a producer of adult content, but rather a middleman etc etc, but basically speaking they have to enforce certain rules at least some of the time, if they're busted not doing so they face being shut down etc.

Public penetration, while occasionally enforced, is considered a "lesser evil" both because it's solo, or *maybe* girl/girl though penetration in public by more than one girl is rare, but either way it's both SOFTCORE, and the models are 2257 CERTIFIED.

If a model was to do something illegal, like illegal illegal such as showing an underage model or whatever, the model would be liable to prosecution, but MFC would ALSO be liable if it could be determined they allowed it to occur by negligence or non enforcement of rules.

I'm not usually a fan of authority, but I'm siding with Leo on this one - the rules are clearly stated, and some people getting away with some of them some of the time is no reason to bitch if you get caught and punished.

That would be no different to a murderer objecting because his brother-in-law got let off for speeding.

Or for that matter complaining about a speeding ticket because the car in front of you was going the same speed - tough shit, you break the rules you have a chance of being caught an potentially a punishment fitting the severity of the offence.

And just like cops, admins can't be everywhere at once. How could they possibly police upwards of 1000 rooms on both homepages to make sure all the rules were being followed?

I'm not even suggesting anyone should follow any rules they don't agree with - by all means follow your own moral compass. If you get caught because of something you did - own it.

Have the 'most popular rooms' up on a browser nearby.
Glance over at it every half an hour to see if there are any obvious transgressions, fine/ban the models.

A quick glance over popular room topics indicates 8 clearly rulebreaking shows - most in the top 15.

This would at least set a tone.
Either that, or get rid of the rules that you're not enforcing.

You delegate and distribute via the "community" you build. Build in a report button into each room. When it is pressed it takes a screenshot and generates and submits report to admins. The report button, once pressed by one user, cannot be pressed again by anyone for at least one minute. You reward correctly reported violations with 50 tkns. If multiple people managed to report the same violation, you split the tokens.

If a user repeatedly reports incorrectly, they have the privileged revoked (3 strikes of bad reports = removal of privilege, to prevent attempted black mail by members) and a "low trust" added to their profile (to signify they suck). Reporting is limited to premium users with more than just the basic $20 initial buy in (again, to dissuade black mail/spammers/those who low investment in their account). At first the reports would be massive...but once it was in place for a week or two, it'd die down as models would find it hard to break the rules without someone jumping on it fast. Ergo, profitability of breaking a rule is removed.

Extra thought could be put in to develop a system better, but honestly, I'd fucking hate it if they did something like this. The place is bad enough with White Knights being way overly protective ... imagine what it'd be like with the self styled "Police" trawling the rooms simply trying to catch girls out. Yes, they should be aware of the rules, but I'd imagine some may simply be desperate and taken advantage of by the scum that lurk on MFC...

Thought I would just clarify this a bit: you do not need a license for what MFC does. To be honest, I have yet to hear of a license for adult content specifically. The only licenses used are usually just in the distribution of content, but it's between third parties (i.e. photographer to website, studio to website and so on) and not government-issued.

There is also no difference between "softcore" and "hardcore" adult content by U.S. law. Nudity is nudity is nudity, and the U.S. just wants to make sure it's not kids being exploited. Hence the 18 U.S.C. 2257 Record-Keeping Requirements Compliance Statement (try saying that three times fast :p). All that is required is a good legal department (or a lawyer you can pay for internet legalese, for those ladies who want to start their own site) and a record keeper.

Truth is, MFC is in no danger of being shut down for having live sex on their site. They are only in danger for not having model verification. This service is an interactive computer service as defined under 47 U.S.C. § 230(f), as well as an Internet access service as defined under 47 U.S.C. § 231(e), that is statutorily exempt from being considered a producer under 18 U.S.C. § 2257(h)(2)(B).
However, we fully support and comply with 18 U.S.C. § 2257 and 28 CFR Part 75.

MFC is required to be shown to be enforcing some rules to keep their legal status, because as soon as they become considered a "producer" of content under US law they're liable, completely, for anything that happens on the site.

You could commit any crime you want on cam and as long as he had your 2257, the law can't touch him. But the fact of the matter is it's marketing on a truly MASS scale. That's why it works. If you don't like that aspect then sites where it's private, group, or nothing are the way to go.

Hm? I'm not sure if you're directly addressing me or not. The point I was making was MFC is not in any danger at all wth having live sex on their site, as long as they have the model identification. You are correct that they are not a direct producer. I don't believe I said otherwise. However, while being a service provider, they are still required to have identification of any model featured on this site, as long as they plan to sell to United States customers.

The other point I was making was the simple fact of softcore does not exist on MFC if there's penetration involved. No matter how you may view it, it is a hardcore act by definition. So, it has nothing to do with legal obligations for keeping wang off-camera. It's a personal choice to keep the site female-only. Which means any males visible on cam are by default without identification. Hence the swift banination!
