Bitter sweets: Iowa man fired after using forklift to retrieve Twix from busted vending machine

He was fired five days later.

Last month a state administrative law judge ruled McKevitt was not entitled to unemployment benefits.
Speaking to the Des Moines Register, McKevitt, who served in Iraq, denied lifting the machine, and instead said he’d used the forklift just to move it back into place after shaking it.

“That machine was trouble,” he said. “They fired me, and now I hear they have all new vending machines there.”

Court Approves School Ban On Shirts With the US Flag on Cinco De Mayo

CNN) -- A California school that stopped students from wearing American flag T-shirts on Cinco de Mayo didn't violate their constitutional rights, an appeals court ruled Thursday.

The school's approach, according to the appeals court, kept students safe in a climate of racial tension.

"The controversy and tension remained," a panel of judges from the 9th Circuit Court of Appeals said in their opinion, "but the school's actions presciently avoided an altercation."

School officials were worried about violence and disruption of school activities "and their response was tailored to the circumstance," the opinion said.

The case dates back to May 5, 2010, when the principal of Live Oak High School in Morgan Hill, California, asked a group of students wearing American flag T-shirts to turn their shirts inside out or take them off.

The students at the Northern California school refused, according to the appeals court's summary of the case, and later brought a civil rights suit against the school and two administrators, arguing that their rights to freedom of expression, equal protection and due process had been violated.

Judges said the civil rights case forced them to weigh the difficult question of what takes precedence: students' free speech rights or school safety concerns?

According to court documents, the incident occurred amid "ongoing racial tension and gang violence within the school, and after a near-violent altercation had erupted during the prior Cinco de Mayo over the display of an American flag."
The previous year, court documents said, a group of students carrying a Mexican flag had clashed with students who hung an American flag from a tree and chanted "USA" on Cinco de Mayo, a holiday marking a famous Mexican military battle that is often celebrated in the United States.

In 2010, the appeals court said, "threats issued in the aftermath of the incident were so real that the parents of the students involved in the suit kept them home from school two days later."

This. I don't think it's any worse than schools that have dress codes against gang-related items of clothing in areas where gang violence is prevalent. They only banned the shirts on Cinco de Mayo because the kids who wore them on May 5th did it deliberately to instigate racial tensions. It's not like they are forcing everyone to renounce God and America and salute Che Guevara or anything, they're just trying to keep the peace.

Of course there'll still be some dumbass kids screaming "THIS IS AMERICA SPEAK 'MERICAN" but you have to take baby steps, I guess. :/
 
It's BS because the school is caving in from the threat of violence over a holiday we don't even officially observe. Wearing a T-shirt with the US flag isn't the problem, so punishing kids for being patriotic on any day is wrong. Deal with the real problem instead of placating to those who threaten violence or the problem will just escalate.

1 in 10 Americans think HTML is an STD, study finds

77% of respondents could not identify what SEO means. SEO stands for "Search-Engine Optimization"

27% identified "gigabyte" as an insect commonly found in South America. A gigabyte is a measurement unit for the storage capacity of an electronic device.

42% said they believed a "motherboard" was "the deck of a cruise ship." A motherboard is usually a circuit board that holds many of the key components of a computer.

23% thought an "MP3" was a "Star Wars" robot. It is actually an audio file.

18% identified "Blu-ray" as a marine animal. It is a disc format typically used to store high-definition videos.

15% said they believed "software" is comfortable clothing. Software is a general term for computer programs.

12% said "USB" is the acronym for a European country. In fact, USB is a type of connector.

Despite the incorrect answers, 61% of the respondents said it is important to have a good knowledge of technology in this day and age.

The study involved 2,392 men and women 18 years of age or older. The participants were not told that the study was specifically looking into their knowledge of tech terms. They were presented with both tech and non-tech terms and were asked to choose from three possible definitions.

Massachusetts court says 'upskirt' photos are legal​

(CNN) -- Massachusetts' highest court ruled Wednesday that it is not illegal to secretly photograph underneath a person's clothing -- a practice known as "upskirting" -- prompting one prosecutor to call for a revision of state law.

The high court ruled that the practice did not violate the law because the women who were photographed while riding Boston public transportation were not nude or partially nude.

"A female passenger on a MBTA trolley who is wearing a skirt, dress, or the like covering these parts of her body is not a person who is 'partially nude,' no matter what is or is not underneath the skirt by way of underwear or other clothing," wrote Justice Margot Botsford of the state Supreme Judicial Court.
CNN legal analyst Sunny Hostin said the law has not caught up to technology and called it an assault on a woman's right to privacy.

"I think the courts got it wrong," Hostin said. "The spirit of the law makes it clear it is about the person's privacy."

The ruling stems from the case against Michael Robertson, 32, who was arrested in 2010 and accused of using his cell phone to take pictures and record video up the skirts and dresses of women on the trolley, according to court documents.

Two separate complaints were filed against Robertson with the transit police. Authorities then staged "a decoy operation" to catch Robertson, who was eventually arrested and charged with two counts of attempting to secretly photograph a person in a state of partial nudity. Police observed him point a cell phone video camera up the dress of a female officer, court documents state.

Wednesday's ruling reversed a previous decision by a lower court, which had denied a motion by Robertson seeking the dismissal of the case, said a statement from the Suffolk County district attorney's office.

"In sum, we interpret the phrase, 'a person who is ... partially nude' in the same way that the defendant does, namely, to mean a person who is partially clothed but who has one or more of the private parts of body exposed in plain view at the time that the putative defendant secretly photographs her," the high court ruled.

The ruling that state law "does not apply to photographing (or videotaping or electronically surveilling) persons who are fully clothed and, in particular, does not reach the type of upskirting that the defendant is charged with attempting to accomplish on the MBTA."

Prosecutors had argued that the current statute, which prohibits secretly photographing or videotaping a person who is "nude or partially nude," includes upskirting, according to documents.

But Robertson's lawyers argued that the female passenger on the trolley was not "nude or partially nude" and was not in a place where she had a reasonable expectation of privacy, according to court documents.

"Every person, male or female, has a right to privacy beneath his or her own clothing," Suffolk County District Attorney Daniel Conley said in a statement Wednesday. "If the statute as written doesn't protect that privacy, then I'm urging the Legislature to act rapidly and adjust it so it does."

Robertson's lawyer, Michelle Menken, did not return a phone call seeking comment.

Robertson faced misdemeanor charges punishable by up to two and half years in prison.

2 porn channels may need more Canadian content, CRTC says

The federal broadcast regulator wants the naked truth about a couple of porn channels.

The Canadian Radio-television and Telecommunications Commission says AOV XXX Action Clips and AOV Maleflixxx may not be airing enough Canadian content or closed captioning.

The X-rated specialty channels are supposed to air 35 per cent Canadian programming over the broadcast year and 90 per cent of its content should have captioning.

'Upskirt' ban in Massachusetts signed into law

(CNN) -- Modern-day peeping Toms in Massachusetts, the sorts who get their thrills snapping "upskirt" photos on crowded subways, now have their behavior criminalized.

Gov. Deval Patrick signed a bill Friday, according to his office, making photographing or recording video under a person's clothing -- think down a blouse or up a skirt -- a misdemeanor.

"The legislation makes the secret photographing, videotaping, or electronically surveiling of another person's sexual or other intimate parts, whether under or around a person's clothing or when a reasonable person would believe that the person's intimate parts would not be visible to the public, a crime," Patrick's office said in a prepared statement.

The crime is punishable by up 2½ years in jail or a fine of up to $5,000.

In addition, the law states that "whoever videotapes or photographs, with the intent to secretly conduct or hide such activity, the sexual or other intimate parts of a child" faces a sentence of 2½ to 5 years and up to a $5,000 fine. The law goes into effect immediately.

Victim of "upskirting" speaks out

Lawmakers hastily drew up and passed the bill Thursday, a day after the state's highest court ruled that current laws against secretly photographing a person in a state of partial nudity don't apply to these sorts of secretive shots.

Though a lower court ruled against him, Robertson found his case dismissed Wednesday -- and outraged lawmakers got to work.

"We are sending a message that to take a photo or video of a woman under her clothing is morally reprehensible and, in Massachusetts, we will put you in jail for doing it," state Senate President Therese Murray said in a prepared statement. "We will need to revisit this law again and again as technology continues to evolve and ensure that we are providing the necessary protections."

Recognizing how technology plays a part in amplifying the violation is key, victim advocates say. The images can, in no time, make the international rounds online.

"I think there's a fear among people that you could have an 'upskirt' photo taken of you and never realize it," said Emily May, executive director of ihollaback.org, a website that encourages women to share their stories and cell phone photos of harassers. "Your crotch could be on the Internet, and you may never know about it."

-- A Cessna collided with a parachute at a small airport in Polk County, Florida, on Saturday.

The plane took a nose-dive and the skydiver was thrown to the ground.

Neither the pilot nor the skydiver were seriously injured when they fell about 75 feet, according to the Polk County Sheriff's Office.

Sharon Trembley, 87, was doing what are called "touch and goes" with the Cessna, a maneuver in which the plane touches the ground and ascends again. The Polk County Sheriff's Department initially identified the pilot as Shannon Trembley.

On his third time up, one wing became tangled in the strings of the parachute that held 49-year-old John Frost, officials said.
Both men were taken to a hospital. Frost was treated and released and Trembley was being held for observation on Saturday night.

Officials said the National Transportation Safety Board and the Federal Aviation Administration were notified and responded to the scene.

The announcement on Wednesday comes at an awkward time as Russia currently stands accused of invading Ukraine, something most people recognize as one of the most un-peaceful things a leader can do.

Voice of Russia notes that the nomination had likely been submitted back in October, when Putin had just acted as a main figure in the deal to disarm Syria of its chemical weapons. This didn't take into account that Putin was also providing Syria with conventional weapons, but such is the way the Nobel Peace Prize works. It's a system much like the Pulitzer Prize, where it's actually surprisingly easy to get nominated for the award and often doesn't really mean anything.
Why stop at Putin? Go ahead and add North Korea's "Great Leader" as well!

You would think that the Nobel committee would just put things like this in "file 13", because even a passing acknowledgement makes them look ridiculous. I guess that wouldn't be politically correct.

Man Tries to Run From Police While Carrying a Stolen Snake

Talk about a bizarre crime. A man was caught red-handed while running from a pet shop with exotic animals.

Police describe a scene that sounds like something straight out of the movies. They say a man tried to run from them while carrying a large albino snake.

It all started just after 9 o’clock Monday morning. Police say the man had broken into the exotic pet store located near 84th and I. When police arrived they saw the man near the front door trying to steal some animals, when they spotted him he bolted towards the back door, animals in hand.

Police captured the man shortly after. The Humane Society had to be called in to help round- up the animals that had gotten loose inside the store. Police say that many of the animals were priced at a few hundred dollars, up to thousands of dollars.

Police did find an iguana in the man’s car. Store employees were outside the store looking for animals that had escaped. It is not known at this time what kind of animals escaped and how many are missing.

Crazed kitty attacks baby, forces family to call 911

PORTLAND, OR (KPTV) - A fat cat with a bad attitude attacked a baby and forced a Portland family to hide in a bedroom before calling 911.

Police were called out to deal with the crazed kitty at The Yards at Union Station complex on Northwest Naito Parkway just before 8 p.m. Sunday.

The man who called 911 told the dispatcher the cat "went over the edge," and was charging at them every time they opened the door.

"He's trying to attack us," he said. "He's very, very, very, very hostile."

911 operators confirmed the baby did not need medical attention before sending officers to the scene.

"The 911 operator stayed on the phone with the caller to ensure the family, including the dog, remained safe in the bedroom as the cat screeched in the background," a Portland Police Bureau press release states.

The responding officers snagged a dog snare to use in case it was needed to take the alleged cat criminal into custody.

The cat, named Lux, weighs 22 pounds.

When officers opened the door to the apartment, a black and white Himalayan darted into the kitchen, "attempting to flee custody," police said.

The dog snare came in handy, as it was used to put the cat behind bars in a crate.

Officers then told the family it was safe to come out of the bedroom.

"The cat remained behind bars in the custody of the family and officers cleared the scene and continued to fight crime elsewhere in the city," the Portland Police Bureau stated.

A motive for the feline's frantic behavior has not been revealed. However, the man who called 911 told the dispatcher he had "kicked the cat in the rear" after it attacked the 7-month-old child.

"He's got kind of a history of violence," the caller told a 911 dispatcher. "He's kind of a violent cat already. But he's really bad right now."

By Monday, everything had calmed down. Lux was hiding under a blanket when a Fox 12 crew arrived at the scene.

I love cats and pets in general, but this family is really stupid. There are some families and some pets who are not a good match, and hearing the history, why was the cat not kept out of the room(s) where the baby was? There are plenty of instances where a nice and normal pet showed aggression to a new baby, but a cat that has "a history of violence"? They will be lucky if they don't get a visit from CPS.

Arkansas middle school teacher apologizes for showing sexual image of herself in class
An Arkansas middle school teacher has apologized after accidentally showing a sexual picture of herself to her Little Rock School District class.
The incident happened last week at Forest Heights Middle School when the teacher made a mistake while trying to play something from her iCloud account and transferred the inappropriate picture to the iPads in the classroom.

"Images of herself were incorporated with class work. (My son) says she was performing sex acts," parent Nicholas Tolerson told Arkansas Matters. "My heart goes out to not only my son, but other kids in the classroom.”

A competitor at the North American Grappling Association's Grappling Championship had a move in his arsenal that his opponent didn’t see coming -- but he certainly smelt it.
During a video that was shot at the event, one man submits in his match after his opponent apparently farts in his face. It’s not exactly clear in the clip, but the victim appears to say, "He farted in my face ... You farted in my face, man."

He then vomits on the mat.

This really isn't too weird and wacky, I just want to put this somewhere since it's news to me. :-D Studying for midterms and I just reviewed some stuff we went over in cell biology and it got me thinking, no wonder I try to argue with most people about GMO's. (I'm not saying that they are completely safe, I'm just saying that I feel many people that are anti-GMO'S are misinformed or are completely jumping to radical conclusions about them.) Anyway, just because something is a GMO does not necessarily mean it's bad for you. GMO's can be beneficial too! :dance:

This is taken directly from my lecture slide. SDS-PAGE is essentially the same reagent that is used in detergents, such as shampoo. It is VERY bad to ingest.

Michigan company AirBlade has developed a life-sized air hockey table, big enough for humans players. Just like its diminutive arcade version, AirBlade’s 24-foot-by-40-foot rink features air forced through small holes on the playing surface, producing a zero-friction cushion of air on which the puck floats.

To replicate the wild ricochet effect of the original game, the puck is lighter and flatter than a real hockey puck. The rink includes traditional hockey nets, with one added feature: a slot in the back of the net worth extra points, which developers call the “hockey equivalent to the basketball three pointer.” Players can either wear roller blades or tennis shoes.

While the current rink is a kid-sized prototype, AirBlade creators have bigger goals on the horizon. They’re finalizing the engineering and construction of what will become the 85-foot-by-200-foot AirBlade Professional Extreme Rink, featuring 2.2 million airflow holes and 10-foot embankments behind the baseline to accommodate trick shots. Developers envision a massive double-elimination air-hockey tournament this summer at a major sports arena in Detroit.

Is there really a need for this? Like the Pizza Hut ordering table, how much money was used to develop something we already have? An adult-size air hockey rink? WTF is wrong with street hockey, or inline hockey, or God forbid...ICE HOCKEY? Obviously, it's very cool, and a lot of talent (and money) went into this, but really now.

One more "mis-use" of advanced tech and manufacturing, IMO. Just because it can be done, doesn't mean it should be done. If they are able to follow through with this, how long before they go bankrupt? Air Hockey is 50 cents - $1 to play. This thing will be a lot more than that, lol.
