The capability is certainly there, but if sites are found to be doing this, they should be avoided like the plague. If a business labels an area private, either online or in a brick building, then the customer has a reasonable expectation that that area IS private. This, to me, is no different than a business owner installing secret cameras in women's restrooms. Their motive is unimportant.
Unfortunately, most sites bury their privacy policies in unnecessarily long terms of service documents that people rarely read before clicking on "I agree." Sometimes they're pretty vague about how and where your information will be stored or used. Unless your communications are encrypted, or they specifically say they won't read your mail, don't assume it's truly private. I think, in this digital age, the word "private" is being redefined as "not viewable to the general public."
How incredibly silly would it be of anyone here to start trashing Amber in a PM and then get upset if she saw it and proceeded with disciplinary action?
As far as cameras in washrooms go, that's different. Legality aside, if they put a sign on the door that indicated video surveillance was being used, entering the facilities would generally imply acceptance of the conditions. Waiting until one made it home or fertilizing the vegetation in behind the building would demonstrate the refusal of these conditions.
